These Terms of Use (“Terms”) govern your access to and use of the website at selfemployedhealthbenefits.com (SelfEmployedHealthBenefits.com — the “Site”), which is owned and operated by BK Benefits Consultants, LLC. (“BK Benefits Consultants,” “we,” “us,” or “our”).
1. Acceptance
By accessing the Site, submitting the request form, or otherwise interacting with us through the Site, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site. The Site does not offer user accounts or logins; these Terms apply to every visitor.
2. Use of the Site
You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You will not attempt to interfere with the Site’s operation, scrape or harvest data, impersonate any person or entity, submit information you are not authorized to submit, or use the Site to harass or defraud any person.
3. Insurance Information & Disclaimers
The Site provides general information about insurance and is provided for informational and marketing purposes only. It is an invitation to inquire, not an offer to contract, and it does not constitute an offer of insurance, a binding insurance quote, or a guarantee of coverage. No specific insurer or insurance policy is advertised on the Site. Insurance products contain exclusions, limitations, reductions of benefits, and terms under which a policy may be continued in force or discontinued. All insurance products are subject to underwriting, eligibility, and the actual terms of the issued policy; coverage details, benefits, limitations, and exclusions are determined by the individual policy issued by the carrier. Coverage is placed by licensed individual insurance producers, not by the Site or by BK Benefits Consultants as an entity.
Information on the Site may be general in nature, may not apply to your specific situation, and is not a substitute for professional advice tailored to your circumstances.
4. Producer Relationship
BK Benefits Consultants is a Missouri-licensed insurance entity producer (License #3004163368 · NPN 21307422). We market insurance products and direct inquiries to licensed individual insurance producers; coverage decisions and policy placement are handled by those producers, who are appointed with carriers through their respective contracted agencies. Our own producers include producers appointed through Compass Health Consultants. The producer who works your inquiry is bound by their own licensing, compensation, and compliance obligations.
5. Compensation Disclosure
Licensed insurance producers receive commission compensation from insurance carriers on policies they place. BK Benefits Consultants does not hold carrier appointments and does not directly receive carrier commissions on policies placed; BK Benefits Consultants may receive compensation through marketing and referral arrangements with producers and other partners.
BK Benefits Consultants may be paid for transferring your inquiry. When we transfer an inquiry to a licensed insurance producer named on our partner roster, that producer may pay us a fee for it. We are paid whether or not you buy anything. You authorize that transfer on the request form, and you can withdraw your authorization at any time through Your Privacy Choices.
Withdrawing stops the transfer — including a transfer to one of our own licensed producers, who is named on the roster on the same terms as anyone else. It does not erase what you have already sent us: BK Benefits Consultants still holds that information and may still contact you about insurance products and services, as the notice on the request form says. You can stop that separately through Your Privacy Choices.
BK Benefits Consultants may also be paid by an advertiser to include sponsored content inside marketing emails that we send. In those cases we send the message, we control what it says, and the advertiser never receives our contact list or any information identifying you individually. Sponsored content is identified as advertising.
5A. Transfer of Your Inquiry
BK Benefits Consultants does not place insurance policies itself, so every inquiry submitted on the Site goes to a licensed insurance producer — that is the service. When you submit the form you authorize us to transfer your inquiry — including your name, email address, phone number, ZIP code, and the coverage you asked about — to one licensed insurance producer or agency named on our partner roster as of the date you submitted the form, and you acknowledge we may be paid for doing so. That producer may contact you directly and may market health, dental, vision, and life insurance products and services to you. It may not sell, transfer, or otherwise disclose your information to anyone else, and it is required to maintain its own do-not-call list and to honor a request to stop within ten (10) business days.
A producer added to the roster after you submitted your request was not named in your authorization and will not receive your information.
You may withdraw this authorization at any time — through Your Privacy Choices, by emailing optout@selfemployedhealthbenefits.com, or by any other reasonable means. We do not require any particular channel, and the authorization is never irrevocable. A withdrawal reaches information we have already collected as well as anything you submit later, and we check it again before any transfer.
BK Benefits Consultants keeps your information as well. Transferring your inquiry does not end our relationship with you: we may continue to contact you about insurance products and services, including renewal and open-enrollment reminders, until you tell us to stop.
6. Communications & Consent (TCPA)
The request form on the Site includes three checkboxes, none of which is pre-checked — (a) your acknowledgment that you received our Privacy Notice and your agreement to these Terms and our Privacy Policy, (b) your prior express written consent to be contacted, and (c) your authorization for us to transfer your inquiry to a licensed insurance producer or agency named on our partner roster, as described in Section 5A. Checking a box constitutes your electronic signature. All three are required to submit the form: BK Benefits Consultants does not place coverage itself, so sending your inquiry to a licensed producer is the service you are asking for. None of them is irrevocable — you can withdraw any of them at any time, by any reasonable means, as described below, in Section 5A above, and in Section 5 of our Privacy Policy.
The consent disclosure presented with the form reads in full:
“By checking this box and clicking “Request my options,” I provide my electronic signature and my prior express written consent for BK Benefits Consultants, LLC. and the licensed insurance producer or agency named on the partner roster published on this site on the date I submit this form to contact me at the telephone number and email address I provided, including a wireless number, about health, dental, vision, and life insurance products and services. By executing this agreement I authorize those parties to deliver, or cause to be delivered, telemarketing calls and messages using an automatic telephone dialing system, an automated system for the selection or dialing of telephone numbers, an artificial or prerecorded voice, prerecorded voicemail, and text (SMS/MMS) message. I am not required to sign this agreement, directly or indirectly, or to agree to enter into such an agreement, as a condition of purchasing any property, goods, or services. I also authorize BK Benefits Consultants, LLC. to share my inquiry, and any later request that I not be contacted, with that producer. Message frequency varies and message and data rates may apply. I may revoke this consent at any time by any reasonable means, including replying STOP to any text message, telling any caller to stop contacting me, or emailing optout@selfemployedhealthbenefits.com.”
Consent is not a condition of purchasing any insurance product or service. Message and data rates may apply, and message frequency varies. You can opt out of texts at any time by replying STOP to any text message, and reply HELP for help. You can opt out of marketing emails using the unsubscribe link in any marketing email. You may revoke your consent at any time and by any reasonable means — including replying STOP to a text, telling us on a call, or emailing us — and we honor revocations within ten (10) business days. We place outbound marketing calls and texts only between 8 a.m. and 9 p.m. in the recipient’s local time zone.
We retain records of each consent — the timestamp, IP address, browser (user agent), page, and the exact version of the disclosure text agreed to — for at least five (5) years, as described in Section 7 of our Privacy Policy.
7. Cookies & Analytics
The Site uses cookies and similar technologies for analytics and advertising measurement — Google Analytics 4 and Google Ads conversion measurement via the Google tag (with ads personalization disabled for this Site), plus Ahrefs cookieless analytics. When you first visit the Site we display a cookie notice; you can change your choices at any time using the “Your Privacy Choices” link in the footer, and we honor the Global Privacy Control browser signal as an opt-out. Full detail — including the categories of cookies, how consent is requested, and how we keep an audit record of your choice — is in Section 6 of our Privacy Policy. Cookie consent is independent of, and does not substitute for, the contact and TCPA consent described in Section 6 above: accepting cookies does not consent you to being contacted, and declining cookies does not revoke a contact consent you have given.
8. No Guarantees
We make no guarantee that any particular product or premium will be available to you, that you will be approved by any carrier, or that any particular result — including any savings — will be realized. Carrier underwriting determines eligibility and pricing.
9. Disclaimers of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BK BENEFITS CONSULTANTS, ITS PARENT, OFFICERS, MEMBERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SITE, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
11. Indemnification
You agree to indemnify and hold harmless BK Benefits Consultants and its officers, members, employees, agents, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any rights of a third party.
12. Intellectual Property
All content on the Site — including text, graphics, layout, logos, and marks — is owned by BK Benefits Consultants or its licensors and is protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, or create derivative works from any of it without our prior written permission, except as expressly permitted by these Terms or applicable law.
13. Third-Party Links
The Site may contain links to third-party websites or resources. We do not endorse and are not responsible for the content, products, services, policies, or practices of any third-party site you visit through a link from the Site.
14. Modifications
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site after the update constitutes acceptance of the revised Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws principles. The exclusive venue for any dispute that is not subject to arbitration under this Section is the state or federal courts located in St. Charles County or the Eastern District of Missouri, and you consent to the personal jurisdiction of those courts.
You and BK Benefits Consultants agree first to attempt to resolve any dispute arising from these Terms or your use of the Site informally by contacting us at team@selfemployedhealthbenefits.com. If a dispute is not resolved within 30 days, either party may submit the dispute to binding arbitration administered by a recognized arbitration provider, conducted on an individual basis (no class, collective, or representative actions), and held in or near St. Charles, MO, or by remote means as the parties agree.
The foregoing arbitration agreement does not apply to claims for intellectual property infringement, claims for injunctive or equitable relief, or claims that may be brought in small-claims court so long as the claim remains in that forum.
Producers named on our partner roster are intended third-party beneficiaries of this Section and of Section 10, and may enforce them, with respect to any claim arising from an inquiry we transferred to them under Section 5A.
Time limit. To the fullest extent permitted by law, any claim arising from or relating to these Terms or your use of the Site must be brought within one (1) year after the claim arose, or it is permanently barred.
Severability and non-waiver. If any part of this Section is held unenforceable, the rest remains in force. Nothing in these Terms waives any right or remedy that applicable law says may not be waived, and no provision here is intended to limit any such right — several states' telemarketing and consumer-protection statutes expressly forbid waiver, and those statutes control over anything inconsistent here.
